Terms and Conditions
Terms of Use for the online shop of PAEEZE, Tannaz Farasat, Stuttgart.
Note
These General Terms and Conditions have been prepared to the best of our knowledge. No legal guarantee for completeness and topicality is given. For legal questions, we recommend consulting a specialist lawyer.
§ 1
Scope & Provider
These General Terms and Conditions apply to all contracts concluded between PAEEZE, Tannaz Farasat, Sophienstraße 39, 70178 Stuttgart (hereinafter "Provider") and the customer via the online shop under the domain paeeze.de (or the respective valid domain).
Deviating terms and conditions of the customer are not recognized, unless the provider expressly agrees to their validity in writing.
§ 2
Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order.
By submitting an order, the customer makes a binding offer to purchase the selected products. The provider confirms receipt of the order by e-mail. This confirmation of receipt does not yet constitute acceptance of the offer.
A purchase contract is only concluded when the provider expressly accepts the order by a separate order confirmation or dispatches the goods.
§ 3
Prices & Payment
All stated prices are final prices in Euros and include the statutory value-added tax. Shipping costs are transparently displayed at checkout before the order is completed.
Payment is made via the payment methods offered at checkout, including credit card, PayPal, Apple Pay, Google Pay, Klarna and Shop Pay. The invoice amount is due upon completion of the order.
The provider reserves the right to offer certain payment methods exclusively after a credit check.
§ 4
Delivery & Shipping
Delivery takes place within Germany and to all member states of the European Union. For deliveries outside the EU, please contact us directly – we will review your request on a case-by-case basis and get back to you as soon as possible.
Delivery time for standard shipping is 2–3 business days, for express shipping 1–2 business days after dispatch. Orders are usually processed and shipped within 1 business day. We endeavor to ship orders on the same business day – however, there is no guarantee for this.
The risk of accidental loss and accidental deterioration of the sold goods passes to the customer upon handover to the customer or a person authorized to receive them.
§ 4a
Pre-orders & Custom Orders
Individual products in our range are made to order and are not in stock at the time of order. Such products are explicitly marked as pre-orders on the respective product page.
For pre-orders, the estimated delivery time is 2–3 weeks from receipt of order. This information is non-binding and is for guidance only. There is no entitlement to delivery within this period. Delays due to production-related or supply chain-related circumstances do not give rise to any claim for damages by the customer, unless the provider is responsible for the delay.
The provider reserves the right, after receipt of a pre-order, to check whether the ordered item can still be manufactured or delivered. If the provider determines during this check that manufacturing or delivery is not possible, the customer will be informed immediately – no later than 5 business days after receipt of order – by e-mail. In this case, no purchase contract is concluded.
If the purchase price has already been paid in full or in part, the entire amount paid will be refunded within 14 days of the customer's notification via the original payment method. Further claims by the customer, in particular for damages, are excluded, unless the provider is guilty of intent or gross negligence.
The customer's statutory right of withdrawal in accordance with § 6 of these GTC remains unaffected by the above provisions.
§ 5
Retention of Title
The delivered goods remain the property of the provider until full payment of the purchase price.
§ 6
Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal. Detailed information on the right of withdrawal and the cancellation policy can be found on our Returns and Withdrawal page.
The withdrawal period is 14 days from the day on which the customer or a third party designated by him took possession of the goods.
§ 7
Warranty & Defects
The statutory warranty rights apply. The warranty period is two years from the delivery of the goods.
In case of obvious transport damage, we ask the customer to immediately report the damage to the delivery agent and to inform us without delay. Failure to do so will not affect statutory warranty claims.
§ 8
Limitation of Liability
The provider is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on intent or gross negligence.
Otherwise, the liability of the provider is limited to the contract-typical foreseeable damage. Any further liability of the provider is excluded.
§ 9
Data Protection
The collection and processing of personal data takes place in accordance with our Privacy and Cookie Policy. The provider uses the collected data exclusively for contract processing and – with explicit consent – for sending newsletters.
§ 10
Dispute Resolution & Final Provisions
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer and has his habitual residence in another EU member state, the mandatory consumer protection regulations of that state also apply.
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
